Lettingchange: Student HMO arrivals and departures

Simple workflow for letting agents — England
Working guide | 9 October 2026 | Ordinary private student HMOs, not university halls or exempt purpose-built accommodation.
1. Choose the arrangement before granting the tenancy
Arrangement | Rent and vacancy responsibility | Appropriate use |
Individual room tenancies | Each tenant owes their room rent. Landlord carries vacant-room costs. | Incomplete groups or frequent individual changes. |
Joint whole-house tenancy | Joint tenants owe the agreed total rent, ordinarily jointly and severally. | Groups accepting whole-house responsibility. |
Joint whole-house tenancy with approved lodgers | Same agreed total rent. Joint tenants receive lodger income and carry vacancies or non-payment. | Resident tenants wanting to recruit and accommodate additional people themselves. |
Do not mix a whole-house grant with separate landlord lettings of spare rooms: the landlord cannot separately grant rooms already included in the joint tenants' exclusive possession without agreed restructuring.
No occupancy concessions form part of this system. Rent does not automatically change when somebody joins or leaves. Any later increase must follow the applicable statutory process.
2. Complete the initial checks
Confirm the permitted number of people, households and room occupancy under the HMO licence; check planning, insurance and mortgage restrictions where relevant.
Identify exactly what is being let, who the tenants are, the total rent, deposit and any guarantors.
Assess affordability against the rent actually owed. Do not assume future lodgers will fill every vacancy or always pay.
Complete prescribed Right to Rent checks for relevant adult occupiers, including British citizens. Record evidence and follow-up dates where required.
Obtain qualifying student evidence and course dates. Confirm Council Tax classification, statutory liability and any exemption with the billing authority.
If Ground 4A is intended, check every statutory condition and give the required warning before the tenancy is entered into. The ground may apply to individual room tenancies as well as joint tenancies; it does not create a fixed term.
Protect deposits and serve prescribed information separately within the applicable deadline.
Explain the chosen model and departure procedure before signing.
3. If a joint tenant wants to leave
First read their actual message. A request to arrange a replacement, moving out, and a valid notice to quit have different effects.
Situation | Action |
Request for an agreed release or replacement | Check that the message is not also a valid notice; discuss options with all parties. |
Moving out only | Do not assume liability has ended. Establish whether any release, surrender or notice exists. |
Valid notice to quit | Ordinarily ends the entire joint tenancy. Establish the expiry date and contact all joint tenants promptly. |
Do not make exercise of a valid notice conditional on finding a replacement. Any agreed shorter notice period for a joint tenancy requires all joint tenants and the landlord to agree.
Replacement available
Obtain landlord approval and agreement of outgoing, continuing and incoming parties.
Reference and check the replacement, including Right to Rent, student status and occupancy limits.
Choose properly documented assignment of the continuing tenancy, where appropriate, or an agreed ending and new grant.
If a notice has already been served, resolve it expressly before relying on continuation. Withdrawal requires written agreement before it takes effect; record the household's agreed arrangements.
Record the effective date, rent account, existing damage, and treatment of past and future liabilities. Review guarantor cover and obtain fresh commitments where necessary.
Complete the deposit scheme's particular change-of-sharer process and applicable information requirements. A payment between students alone does not update protection.
Update the occupancy register and issue copies of completed documents.
Use an appropriately drafted deed for assignment; changing names on a copy of the agreement is insufficient. A scheme's administrative tenant transfer does not itself change the legal tenancy.
No replacement available
Agree the commercial outcome: remaining tenants take the whole-house liability under properly documented arrangements; landlord agrees a reduction; parties agree conversion to room tenancies; or the tenancy ends and the occupants leave.
If valid notice is not withdrawn, arrange what follows its expiry. Do not treat the old tenancy as continuing with one name removed. Where people remain, document their new rights and use lawful possession procedures if required.
4. If tenants wish to take lodgers
The joint tenants must genuinely remain resident and act as the lodgers' immediate landlords.
Legal status depends on the actual occupation and sharing arrangements, not the label.
Before approving a lodger:
Obtain written permission under the head tenancy and agreement of the joint tenants.
Check occupancy limits and student/Council Tax consequences.
Identify who grants the lodger agreement and receives payment.
Allocate Right to Rent responsibility expressly. Resident tenants ordinarily carry it; a superior landlord can accept responsibility in writing, with a suitable written agent arrangement.
Use a separate agreement covering room, shared facilities, payment, deposit, notice and house rules. Check the lodger's actual legal status and applicable fee/deposit rules.
Explain what happens if a joint tenant leaves or the head tenancy ends. Do not assume the lodger can simply be removed without assessing their rights.
Fixed-rent example
Three joint tenants rent a five-bedroom house at £2,500 monthly. Each approved lodger pays them £500 monthly.
Residents | Rent owed to owner | Lodger income | Original three's combined net cost |
Three joint tenants | £2,500 | £0 | £2,500 |
Plus one paying lodger | £2,500 | £500 | £2,000 |
Plus two paying lodgers | £2,500 | £1,000 | £1,500 |
The owner remains owed £2,500 regardless of lodger vacancies or non-payment. A joint tenant's departure follows section 3; a lodger's departure follows their separate agreement and actual legal status.
5. Keep one occupancy register
Record name, tenant/lodger status, room, arrival/departure date, student evidence and course dates, Right to Rent check and follow-up date, deposit arrangements, guarantor and document references. Keep personal data securely with appropriate retention.
Council Tax: since December 2023, the English owner-liability rules include HMOs using a modified Housing Act 2004 definition. A joint agreement does not automatically put liability on residents.
Establish the statutory owner and exemption position. All qualifying students may support exemption; a non-student arrival, course completion or complete vacancy requires review.
6. Check plans for the next academic year
Ask who intends to stay, leave or recruit a replacement. Treat replies as planning information unless they have a defined legal effect. Do not assume annual renewal is necessary for a continuing periodic tenancy. Arrange viewings by agreement with proper regard to quiet enjoyment.
Final check before any change takes effect
Contractual route agreed; notice dealt with; rent responsibility clear; occupancy approved; Right to Rent completed; student/Council Tax position reviewed; deposit and guarantors addressed; documents completed; register updated.
Tenant-requested variations, assignments or novations: ordinarily a maximum £50 charge, or evidenced reasonable costs if higher. Do not impose blanket reletting charges or charge for exercising statutory notice rights.
