Lettingchange: Student HMO arrivals and departures
Simple workflow for letting agents — Wales
Working guide | 20 October 2026 For ordinary private student lettings under standard occupation contracts. University accommodation, converted contracts and special statutory exceptions require their own checks.
Core rule: identify the contract type and the proposed change before choosing a form. A form does not itself create a right to transfer or withdraw.
1. Choose the arrangement
Arrangement | Rent responsibility | Best suited to |
Separate room occupation contracts | Each contract-holder owes the room rent; landlord carries vacancies. | Incomplete groups and frequent individual changes. |
Joint whole-house occupation contract | Joint contract-holders carry the agreed whole-house obligations. | A group accepting responsibility for the house together. |
Joint whole-house contract with lodgers | Same whole-house rent; lodger income benefits the resident contract-holders. They carry lodger vacancies and non-payment. | A group wanting to recruit and accommodate additional residents itself. |
Fixed terms remain available in Wales. Record whether this particular contract is fixed term or periodic; do not assume every student contract is fixed term.
No occupancy concessions form part of this system. The agreed total rent does not automatically rise or fall when residents change. Do not let the same spare room separately on the landlord's behalf if it is already included in the joint contract-holders' whole-house grant.
2. Before occupation
Check HMO licence conditions, people/household limits, room capacities, planning and relevant insurance/mortgage conditions.
Check Rent Smart Wales registration and licensing responsibilities.
Specify room or whole-house rights, rent, term, deposit and guarantors.
Assess affordability against the whole rent owed, without assuming future lodger income.
Use a current Welsh written statement; issue it within the statutory deadline. Give landlord information using RHW2 where required. Keep proof of service.
Check safety, fitness for human habitation and the property documents appropriate to the letting.
Protect deposits and give required information within the applicable 30-day period.
Record qualifying student evidence and course dates; check Council Tax exemption and liability.
Complete normal identity and referencing checks fairly. The statutory Right to Rent scheme does not apply in Wales, including to overseas students. Do not import the English immigration-check workflow.
Explain the departure and replacement procedure before the group commits.
3. One joint contract-holder wants to leave
Read the written statement, any variations and the person's actual communication. Moving out alone is not a completed release or transfer.
A. During a fixed term
There is no general right to leave a fixed term simply by giving four weeks' notice. Check for an applicable contract-holder's break/withdrawal provision, an agreed lawful release or a permitted transfer. A contract-holder's break clause is distinct from a landlord's break clause.
Replacement available — preferred workflow
Check whether the contract permits transfer of that joint holder's rights and what consent is required. If not, settle the lawful contractual route first.
Obtain the proposal in writing: outgoing person, incoming person and proposed date.
Reference the replacement; check student status, room capacity, guarantors and affordability.
Deal with consent requests promptly under the statutory consent rules. Keep reasons and conditions in writing; do not assume silence is harmless.
Where the fixed-term contract provides for an individual transfer under section 141, the outgoing joint holder gives the other joint holders RHW13 before transfer.
Complete the transfer using RHW11 and obtain the required signatures/consent. Retain service evidence and copies for the parties.
Record treatment of arrears, existing damage and future obligations; do not assume historic liabilities disappear.
Complete the deposit scheme's process and applicable information requirements; review guarantor commitments and supply the incoming holder with the written statement within the statutory timescale.
Update the register and confirm completion in writing.
RHW13 is notification to the other joint holders; RHW11 is the transfer instrument. Do not substitute an English assignment deed or a name change on the old statement for the Welsh statutory process. Section 69 disapplies the ordinary section 52 Law of Property Act deed requirement for the statutory transfer.
No replacement Consider a documented agreed release, an applicable break/withdrawal provision, or an agreed ending and replacement contract. Obtain appropriate agreement from all affected parties and preserve the continuing occupants' rights. Do not present landlord consent as an automatic right or assume every fixed-term contract allows unilateral withdrawal. Make the effective date and full remaining rent obligation explicit.
B. Under a periodic standard contract
An individual joint holder may use the withdrawal procedure without ending the contract for everyone. Under the unmodified model terms:
Give the landlord a written withdrawal notice specifying the withdrawal date.
Allow at least one month. This is the model supplementary withdrawal period; check whether it has lawfully been changed.
The withdrawing holder gives the other joint holders a written warning with a copy of the notice.
The landlord also warns the others as soon as reasonably practicable, attaching a copy.
Record the effective date and address deposit/guarantor administration.
There is no prescribed RHW-numbered form for this ordinary withdrawal notice. It is not RHW11 or RHW13. Do not confuse one month's individual withdrawal with four weeks' notice to end the whole periodic contract. Ending a joint contract requires the joint holders to act together. The remaining holders retain the whole rent obligation; earlier accrued liabilities require separate treatment.
4. Adding someone without a transfer
Where no existing holder transfers their interest, use the adding-a-joint-holder procedure under section 49, with landlord consent under section 50 and the applicable consent rules. Record the agreement of the existing holders and incoming person, the effective date and unchanged total rent.
This is not automatically an RHW11 transaction. Complete written-statement, deposit, guarantor and register updates. If addition follows withdrawal, coordinate the dates rather than assuming they occur simultaneously.
5. Quick form selector
Always obtain the current official form and read its notes.
Event | Form or document |
Transfer the occupation contract as a whole | RHW10; check contractual authority and consent. |
Transfer one joint holder's rights/obligations | RHW11; check contractual authority and consent. |
Prior notification of an individual fixed-term transfer under the section 141 term | RHW13, in addition to the transfer instrument. |
Add a joint holder, with no transfer | Written addition agreement; no general RHW addition form. |
Ordinary periodic individual withdrawal | Written withdrawal notice and warnings; no prescribed RHW form. |
Rent variation under a periodic standard contract | RHW12, subject to the statutory rules; not a routine sharer-change form. |
Ordinary section 173 landlord notice for a periodic standard contract | RHW16, subject to eligibility, restrictions and timing. |
Possession claim for breach or failure to leave following contract-holder notice | RHW23, with the correct ground and procedure. |
Serious rent arrears | RHW20, where that statutory route applies. |
Statutory exclusion of non-occupying joint holder | RHW29 then RHW30, only where section 225 applies and every condition/inquiry/notice requirement is met. |
RHW29/RHW30 are not substitutes for an agreed change of sharer. A holiday, summer absence or missing keys alone does not establish statutory abandonment/non-occupation. RHW14 concerns transfer on death and is outside this routine workflow.
6. Lodgers: preserve the distinction
Check the actual contract first. The Welsh model includes a supplementary term permitting lodgers; do not assume every holder must seek fresh permission if that term remains unmodified. Any agreed approval/notification arrangement must be compatible with the contract, statutory rights and occupancy limits.
The resident contract-holders act as the lodger's immediate landlords. Check actual residence/sharing and legal status; distinguish a genuine lodger from a sub-holder under a sub-occupation contract. Use an appropriate separate agreement covering room, shared facilities, payments, deposit, notice and house rules. Assess what happens if the head contract ends or resident holders leave.
Fixed-rent example
Three joint contract-holders rent a five-bedroom house at £2,500 monthly. Each lodger pays them £500.
Household | Rent owed to owner | Lodger income | Original three's combined net cost |
Three joint holders | £2,500 | £0 | £2,500 |
Plus one paying lodger | £2,500 | £500 | £2,000 |
Plus two paying lodgers | £2,500 | £1,000 | £1,500 |
The full £2,500 remains payable despite lodger vacancies or non-payment.
7. Council Tax, deposits and fees
Council Tax: Welsh HMO valuation/owner-liability reforms took effect on 3 June 2026. Check classification and the statutory owner; do not assume a joint contract transfers liability to residents. Qualifying student-only occupation may be exempt. Review course completion, non-student arrivals and vacancies with the billing authority.
Deposits: use the relevant scheme/product's process for transfer, addition, withdrawal or a new contract. Record any agreed reimbursement between residents, inventory evidence and responsibility for existing damage. A private payment or scheme account update alone does not effect a legal contract transfer.
Fees: do not import England's £50 change-of-sharer allowance. Welsh guidance prohibits contractually requiring a change-of-sharer payment. Refer the agent's administration charge to the landlord under the agency agreement; assess any genuinely separate claim on its own lawful basis.
8. Academic-year planning
Ask about intentions early, but do not promise a vacant house merely because the fixed term has an end date. If holders remain, a periodic standard contract will normally arise. Ordinary private student status does not supply England's Ground 4A or automatically qualify for a special fixed-term possession route. Check the applicable Welsh route before remarketing for guaranteed occupation.
Final completion checklist
Contract type confirmed → legal route selected → consent and notices completed → replacement/occupancy checks passed → effective date and rent clear → deposit/guarantors addressed → written statement/information supplied → register updated.
Keep an occupancy register of names, contractual status, rooms, arrival/departure dates, student/course evidence, deposit and guarantor references, notices and service records. Retain personal data securely.
